RTA Whiplash Claims

RTA  whiplash, (hyperextension of the neck) is the most common injury suffered in a motor vehicle accident.

On 31 May 2021 the government announced new legislation for whiplash reforms, including the level of compensation that can be awarded in a whiplash injury claims and a new portal to claim without legal representation. Note – this reform does not apply to fracture injuries.

Can you recover legal fees?

If you RTA claim whiplash injuries are worth less than £5,000 then you will not be able to recover your legal fees.

What do you need to win your RTA claim?

  • See your GP as soon as possible to record your symptoms
  • Dashcam footage
  • CCTV footage
  • Photographs
  • Witnesses
  • Note the other vehicles details, registration number, drivers name and address
  • Note the other drivers insurance details
  • Speak to the police about your accident
  • Speak to your own insurer about your accident
  • Keep all receipts for travel, medication, treatment, vehicle repairs etc
  • A medical report to prove your injuries (part of the claims process)
