Damages for you injuries
These are known as General Damages. Every injury is attributed a value of compensation depending on its severity, the length of time you take to recover, the pain and suffering you experience together with the impact the injury has on your life, including your inability to play sport or continue with hobbies.
We appreciate no two injuries are the same and that no money can compensate you inadequately for the pain you experience. However, the Court uses a guideline booklet to assess your injury value.
The evidence required to prove the extent of your injury is obtained from an independent medical expert who we arrange to meet with you. This expert produces a report for the Court, confirming your injury diagnosis and provides a prognosis and confirms if any treatment is required.
You may require rehabilitation treatment and it may be that a final medical report is not obtained in your case until your rehabilitation treatment is complete.
Rehabilitation costs
The rehabilitation Code obliges an opponent’s insurance company to offer you rehabilitation treatment. The costs of this rehabilitation can be expensive, and the insurer is asked to pay these fees up front.
Financial Losses
These losses are called special damages and typical losses claimed include, but are not limited to:
- Loss of earnings
- Loss of company benefits
- Private Pension loss
- State Pension loss
- Medication expenses
- Private medical treatment costs
- Medical aids and equipment such as mattress, pillows, tens machine, crutches, special shoes, walking sticks, hearing aids, tinnitus aids or a wheelchair.
- Travel costs
- Parking costs
- Private care and assistance
- Family and friends care and assistance (Hours claimed at an hourly rate)
- RTA - cost of vehicle repair
- RTA - cost of vehicle hire
- RTA – Cost of lost petrol
- RTA – cost of lost car tax value
- RTA – cost of insurance excess
- RTA – cost of vehicle storage
- RTA – loss of use of motor vehicle
- Value of a ruined pre-planned holiday or loss of enjoyment of a holiday
- Damaged clothing
- Paying for DIY
- Paying for garden maintenance
- Paying for car maintenance
- Cost of adapting your home
There are complex rules relating to what losses can be claimed and our claims specialists will let you know whether your losses can be included in your claim for Special Damages.
It is important that you keep a diary of travel – dates, miles or taxi and train costs. Please keep all receipts safe for all items paid for including medication.
